New Hampshire AG Announces Settlement with Medicaid Billing Dispute With Adult Medical Day Care Center
New Hampshire Attorney General Michael A. Delaney announced on February 24, 2012, that the Medicaid Fraud Unit of the Department of Justice has entered into a settlement agreement with Seaside Elderly Day Out Center of Hampton, NH, in which the provider will repay $15,000 to the NH Medicaid Program.
The agreement stems from an investigation of billing by Seaside for adult day care services provided to Medicaid beneficiaries in 2011. Medicaid rules require that an adult medical day care center have on staff at least one full time registered nurse (RN), or a licensed practical nurse (LPN), or both, who shall be available at the center whenever one or more Medicaid participants are present.
The investigation revealed that at times the required RN or LPN was not present at Seaside when Medicaid participants were present. Although the presence of a nurse is not required for state licensing, it is a condition of Medicaid reimbursement. There was no allegation of any intentional wrongdoing. Seaside fully cooperated with the audit.
